The protection of your information is a significant responsibility and we value the trust you place in us. Alysei is respectful of data privacy and strives to adopt best practices in compliance with applicable privacy laws and regulations, including, without limitation, the European Union General Data Protection Regulation (“GDPR”).

This Policy applies to visitors of www.alysei.com (“Site”), subscribers to Alysei’s membership programs, publications, newsletters, or notifications, users of the Alysei mobile application (“App”), content contributors to the Site or the App, any users, viewers, subscribers, or purchasers of Alysei’s products or services, and any of Alysei’s other customers, members, and partners (collectively “you”). The Site, App, Alysei’s products, services, and communications promoted, offered, or accessible on the Site and App, other Alysei-related websites or applications, and any other Alysei product or services related to the foregoing are collectively referred to as “Services.”

We offer a wide range of Services, and sometimes additional terms of Alysei may apply. When you use a Service (for example, buying wine), you may also be subject to additional guidelines, terms, and agreements of Alysei that are applicable to such Service, which are incorporated herein by reference (“Other Agreements”). If this Policy is inconsistent with the Other Agreements, those Other Agreements will control.

We collect information about you when you: communicate with us, visit, use, or download any of our Services, including, without limitation, when you subscribe to our publications, newsletters, or notifications, sign up for a program, participate in a survey, register for an Alysei account, or post, publish, or otherwise take action on or through our Services.
Information You Provide. Depending on which Service you request, we may ask you to give us: your name, postal address, telephone number, email address, date of birth, demographics, desire use, location information, professional affiliations, certifications, permits, business authorizations, nationality, and payment information, as well as any other reasonably identifying information relevant to our Services. Personal information does not include “de-identified,” “anonymous” or “aggregate information,” which are not associated with a specific person or entity.

Information from Others. We also collect personal information about you from others, including, without limitation, when others post content or links that includes information about you.
Information from Your Service Use. We also collect information about you when you visit or otherwise use our Services, such as when you view or click on content or ads, perform a search, install or update the App, share articles, and apply for jobs.

We also collect information about you and the device used to access our Services or to transmit information (such as hardware model, operating system version, unique device identifiers, and mobile network information including phone number), log information (Internet Protocol address, browser type, system activity, hardware settings, browser settings and language, date and time of access, last URL visited, cookies, how you used our Services), electronic tracers (cookies, pixel tags, clear gifs or web beacons) that may uniquely identify your browser, and, if you enable our Service features for location detection, information about your actual location (such as GPS signals and other geolocation data). Alysei uses the personal data you provide to supply you with high-quality products, content, and services as you request, to send important notices, and for internal purposes such as auditing, data analysis, and research to provide you with the information necessary to make informed decisions. We may also use your personal data to offer you products, content, or services that may be of interest to you, based upon your interests or the preferences you shared with us, and may share your personal data with third party sponsors of content, events, and other services or offers. In certain circumstances we may otherwise process your personal data if Alysei has a legitimate interest in doing so and Alysei is not infringing any of your rights and freedoms. Alysei will not use your personal data in circumstances where your rights and freedoms override our legitimate interests, unless we have your consent or are otherwise required or permitted to by law.
Services-related Sharing. Your Alysei member profile is fully visible to all users of our Services. Subject to your settings, your profile may also be visible to non-users, such as on third-party search engines. Your settings, connections to other users, their membership type, and search parameters impact the availability of your profile and whether others can view certain fields in your profile.
Our Services allow viewing and sharing information through posts, likes, follows and comments. When you share interact with publicly, your post can be viewed by all other users and re-shared anywhere (subject to your settings). Users, visitors of the Site or App, and others may be able to find and see your publicly-shared content, including your name and photo. When you like, share, or comment on another user’s content, other users will be able to view such actions.
De-identified & Aggregated Information Sharing. We may share information that is de-identified or in an aggregated form that does not directly identify you.
Third Party and Social Media Plug-in Sharing Third parties may collect information about your online activity over time and across different websites when you use our Services. Other social media networks may embed content and tools on the Site or App as plug-ins, which may collect personal information directly from you in connection with such content and tools. Such networks’ use of personal information is subject to their own privacy policies, which we recommend you review. We are not responsible for such networks’ privacy practices, which are not covered by this Policy.
Affiliated Third Party, Successor, or Assignee Sharing. We may share any of the information we collect with affiliated companies under common ownership or control, such as companies that are part of the Alysei family of companies, and any successors and assignees of Alysei. If we share information, we will require our affiliates to honor this Policy.
Unaffiliated Third-Party Sharing. We do not sell, license, rent or otherwise provide your personal information to unaffiliated third parties except as follows:
If you are an EU resident, Alysei will only share your personal data with unaffiliated third parties with your consent. If Alysei shares your personal data to Alysei’s affiliates or with any other third party as described in this Policy and your personal data will be transferred to a state which is not a member state of either the EU or the EEA, or deemed adequate by the European Commission, Alysei (as a data controller/data exporter) will only conduct such transfer (to a data processor/data importer) if there are suitable safeguards in place, such as binding corporate rules, standard contractual clauses, approved Codes of Conduct, or approved certification mechanism. We use a variety of commercially reasonable safeguards to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction while it is under our control. Under our practices and policies, access to personally identifiable information is limited to those with a legitimate business need. Although we work hard to protect all personal information we collect and store, no data security measures are 100% secure, and we cannot guarantee that our safeguards will prevent every unauthorized attempt to access, alter, destroy, steal, or disclose personal information. Alysei maintains security and incident response plans to handle incidents involving unauthorized access to private information we collect or store. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk. We retain information only as long as reasonably necessary for business, accounting, tax or legal purposes. We are not required to alter or delete information stored for purposes of backup or disaster recovery, or where such action may not be technologically possible.
If you are an EU resident, under the GDPR, you may, among other things, send Alysei a request to (a) confirm that Alysei is processing your personal data, or to access, update or correct the personal data ASP holds about you, or to obtain a copy to reuse for your own purposes, (b) erase your personal data, (c) opt-out of marketing communications from Alysei or (d) restrict Alysei's processing of your personal data. We kindly ask you to send such concerns (or objections) in written form stating your name, address and phone number, so that we can confirm your identity. If you inform us that you want your personal data erased, or that you no longer wish for us to communicate with you for marketing purposes, or to otherwise restrict Alysei's processing of your personal data, we may retain some basic information in order to avoid sending you unwanted materials in the future, and to keep a record of your request and our response.
No Control over Others. If you voluntarily disclose personal information in a public area of our Services, that information may be collected and used by others. We do not control the actions of our visitors and other users of our Services. If you disclose personal information in a publicly accessible place in the Site or App, you do so at your own risk and you understand that your submitted information may be collected and used by others to send you unsolicited messages, advertisements, or for other purposes. The foregoing does not waive Alysei’s right to enforce any legal and contractual rights it may have against those who scrape, crawl, or extract data from our Services, including any such restrictions that may be set forth in our other posted terms and policies.
Opt. Out. . If you register for our Services, we may send you information about our Services or third-party products and services we believe may be of interest to you. If you do not want to receive these types of messages, please let Alysei know by sending us written notice in accordance with our notice provisions below. Alysei may provide opt-out procedure in its marketing communications via an “unsubscribe” link in emails, which would unsubscribe you from any further communications from us that are unrelated to the Services we are providing. It may take time to process your requests, consistent with applicable law. Please note that you do not have the ability to opt-out of non-marketing communications that we send you in connection with the use of our Services, such as when you have engaged in transactions with us.
Account Closure. If you choose to close your Alysei account, we endeavor to stop making your personal information visible to others on our Services as soon as possible after your request. We generally attempt to delete closed account information within 30 days of account closure, except as noted below.
We retain your personal information even after you have closed your account in order to comply with any legal obligations or regulations, resolve disputes, maintain security, prevent fraud and abuse, enforce our agreements, or fulfill your request to “unsubscribe” from further messages. We will retain de-personalized information after your account has been closed.
Information you share with others through our Services will remain visible after you close your account or delete the information from your own profile. We do not control information that other users copied out of our Services. Your profile may continue to be displayed in others’ services until they refresh their cache.
Information about Children. We are committed to protecting the privacy of children. The Services are not designed or intended to attract or target children under the age of 18. The Services do not collect personal information from any person whom we actually know is under the age of 18.
California Privacy Rights. . California Civil Code Section 1798 entitles California customers to request information concerning whether a business has disclosed personal information to any third-parties for the third-parties’ direct marketing purposes. We will not sell or share your personal information with non-affiliated companies for their direct marketing purposes without your consent. California customers who wish to request further information about our compliance with this law or have questions or concerns about our privacy practices and policies may contact us.
Links to Other Websites or Applications. On or through the Services, we may provide links to third party websites. We are not responsible for the content or information collection practices of those sites, including their privacy policies. Please review their privacy policies and content or information collection practices before using such third-party applications or visiting their sites.
De-identified Data. Alysei may anonymize or de-identify information collected by Alysei so that the information does not identify you. Notwithstanding any other provision in this Policy, Alysei’s use and disclosure of de-identified information is not subject to any restrictions under this Policy, and we may disclose it to others without limitation.
Notice to Non-U.S. Users. Our computer systems are currently based in the United States, so all personal data will be processed by us in the United States where data protection and privacy regulations may not offer the same level of protection as other parts of the world, such as the EU. If you create an account with Alysei as a visitor from outside the United States, by using our Services, you consent to the transfer of all such information to the United States, which may not offer an equivalent level of protection as required in the EU or other countries. Regardless of where your information is processed and transferred from, we apply the same protections described in this policy.
Disclaimer. The Representations and Warranties set forth in this Policy, if any, are Alysei’s only Representations or Warranties. No others are implied. Alysei expressly disclaims any responsibility for acts or omissions by other users of our Services. If you are dissatisfied with our Privacy Policy, your sole remedy is to discontinue using our Services. Some jurisdictions do not allow the disclaimer of warranties, so such disclaimer may not apply to you.
Limitation of Liability. The Security of your is important to Alysei. However, no method of electronic transmission or storage is 100% secure. We strive to use all commercially acceptable means to protect your data, but cannot guarantee its absolute security. Alysei shall not be liable for any disclosures of personal information as a result of hacking, inadvertent disclosures, system failures, hacks of third parties, court orders, or any other event that results in the disclosure of personal information. Some jurisdictions do not allow the exclusion of damages, so such exclusions may not apply to you.
Limitation on Time to File Claims. Any cause of action or claim you may have arising out of or relating to this Policy must be commenced within six (6) months after the cause of action accrues, or else such claim or cause of action is permanently barred.
Release. If you have a privacy dispute or concern with any other users or affiliated third parties, you release Alysei and all its associates from any claims or damage awards (actual or consequential) resulting from the cause of action from the breach of privacy. By agreeing to this Policy, you expressly waive any protections that would otherwise limit this release.
Governing Law. By using any of our Services, you agree that this Policy and your use of the Services shall be governed exclusively by the laws of the State of Illinois without regard to conflict of laws principles, regardless of your location when accessing the Services. This Policy is entered into and performed in Chicago, Illinois, USA. This Policy does not give rise to personal jurisdiction over Alysei, either specific or general, in jurisdictions other than Illinois. If you use our Services from outside the United States, you are solely responsible for compliance with local and international privacy laws.
Dispute Resolution. The parties shall attempt to resolve any disputes through good faith business negotiations. Except as otherwise determined by Alysei, in its sole discretion, all disputes or claims arising out of or relating to this Policy shall be settled by arbitration, to be conducted by a single arbitrator in Chicago, Illinois, in accordance with the commercial rules of the American Arbitration Association; provided that the arbitrator shall not have authority to issue injunctions. The costs of the arbitration and the reasonable attorneys’ fees of Alysei shall be included in any award rendered by the arbitrator. The proceedings shall be conducted only in English. Judgment upon the award may be entered in any court having jurisdiction. Other legal proceedings, if any, shall be initiated and maintained in State or Federal court in Cook County, Illinois, and in the event Alysei brings such legal proceeding against you to enforce Alysei’s rights hereof, the costs and expenses incurred by Alysei (including attorneys’ fees) in connection with such legal proceeding shall be paid for by you. The parties expressly submit to the exclusive personal jurisdiction and venue of these courts and waive any objection on the grounds of personal jurisdiction, venue, or forum non conveniens.
Amendment of this Policy. Alysei may amend, add or remove any portion of this Policy from time to time, in its sole discretion with or without notice to you, by posting such changes on the Site or App. Once posted, such changes shall come into full force and effect. In addition to other forms of acceptance, use of our Services constitutes acceptance of this Policy, including continued use after such changes are posted. It is your responsibility to check periodically for changes to this Policy.
Notices. Any notice to Alysei must be in writing and must be sent via email to [email protected] and by registered mail or overnight courier to Alysei Corp., P.O. Box 11600, 355 E. Ohio Street, Chicago, Illinois 60611-7223. Notices to you shall be sent by email to the address provided during registration, or as subsequently updated by you, or via posting on the Site or App, any of which shall be sufficient notice to you. Notice shall be deemed given 24 hours after it has been sent or posted through our Services. If you change your email address, you are responsible for updating your account profile.
Severability. Any provision of this Policy held by an arbitrator or court of competent jurisdiction to be invalid or unenforceable, shall be severed from this Policy, and the rest shall remain in force. If part of a provision is held invalid or unenforceable, the remainder of the provision will remain in force to the fullest extent permissible.
No Waiver. The failure by Alysei to exercise or enforce any rights or provisions of this Policy shall not constitute a waiver of such rights or provisions.
No Partnership. No partnership, joint venture, franchisor-franchisee, or agency relationship is intended or created by this Policy.
Assignment. You may not assign or transfer this Policy or your obligations hereunder in whole or in part, whether by operation of law or otherwise, without Alysei’s prior written consent. In the event of a permitted transfer, this Policy shall bind and inure to the benefit of the parties, their respective successors and permitted assigns. To the extent any novation is required for Alysei to assign this Policy, you hereby appoint the officers of Alysei as your attorney-in-fact to execute all documents necessary to consummate such novation.
Survival. All provisions in this Policy regarding representations and warranties, content, indemnification, disclaimers and limitations on liability shall survive any termination of this Policy.
Force Majeure. Any failure by Alysei to comply with the terms of this Policy shall not be considered a breach of this Policy if such failure is caused by a labor dispute, unstoppable cyber-attacks, government interference, fire, earthquake, flood, or any other event beyond the control of Alysei, provided that Alysei uses reasonable efforts, under the circumstances, to protect information and inform users and visitors of potential leaks.
Language. If a translation of this Policy into any other language is required by law, the English version will prevail to the extent that there is any conflict or discrepancy in meaning between the English version and any translation thereof. If this Policy are provided to you in a language other than English, Alysei does so solely for your convenience.
California Residents. Under California Civil Code §1798.83, California residents who are users or members of Alysei may request information once a year about how we share their personal information with third parties for their direct marketing purposes. Entire Agreement. This Policy, the Terms of Use, and any applicable Other Agreements contain the entire agreement between you and Alysei, and supersede all previous communications, representations, understandings and agreements, either oral or written, between us.
